Our Terms of Use

Our Terms of Use are the rules by which one must agree to abide in order to use our website and our services.

PLEASE READ THIS TERMS OF USE (the TOU or Agreement) CAREFULLY BEFORE USING DJL TRAINING, INC.'S WEBSITE (the Site) OR ANY SERVICE PROVIDED THEREIN (Service). 

This TOU is between you (You, Your, and Yours) and DJL Training, Inc. (DJL Training). By using this Site or any Service of DJL Training, you signify your agreement to these terms of use. If you do not agree to these Terms of Use, do not use this Site or Service.

Restrictions On Use of Materials and Intellectual Property Rights

This Site or Service and all of DJL Training’s products, trade names, marks, and logos are protected by copyright, trademark, and other intellectual property laws, and all intellectual property rights therein belong to DJL Training and/or its affiliates and/or its suppliers (collectively, the "DJL Training’s Intellectual Property"). Any textual or graphic material you copy, print, or download from this Site or Service is licensed to you by DJL Training for your personal, non-commercial home use only, provided that you do not change or delete any copyright, trademark or other proprietary notices.  You may not sell, reproduce, distribute, modify, display, prepare derivative works based on, re-post or otherwise use any of DJL Training’s Intellectual Property in any way.


Furthermore, you may not use DJL Training’s Intellectual Property on any other site or service, in a networked computer environment or in any other medium for any purpose. DJL Training reserves the right to terminate your access to this Site and to use any of its intellectual property at any time.

Use of Content

By posting communications to or transmitting through the Site or Service, you hereby grant DJL Training a royalty-free, perpetual, irrevocable, transferable, non-exclusive license to use, reproduce, modify, publish, edit, translate, distribute, perform, and display such communication(s) alone, for marketing purposes, or as a part of other works in any form, media, or technology, whether now known of hereafter developed and to sublicense such rights to anyone.


Anything you transmit or post may be used by DJL Training or licensed to others by DJL Training for any purpose, including but not limited to reproduction, disclosure, transmission, publication, broadcast and posting, or developing, manufacturing and marketing products using such information.

Conduct

As a user, you are responsible for your own actions, and the consequences of those actions. Proper conduct on the DJL Training Site includes refraining from posting material that is:

  • Copyrighted, unless you are the copyright owner or have the permission of the copyright owner
  • Revealing of trade secrets, unless you own them or have the permission of the owner
  • In violation of any law or infringing on any other intellectual property rights of others, or on the privacy or publicity rights of others
  • Obscene, sexually explicit, defamatory, threatening, harassing, abusive, hateful, or embarrassing to another user or any other person or entity
  • An advertisement, promotional material, "junk mail," "Spam," chain letter, pyramid scheme or any other form of solicitation of business

Users also must not:

  • Impersonate another person
  • Misrepresent their affiliation with any person or organization
  • Access the Site to obtain a list of users of the Site
  • Use password protected, secure, or non-public areas of the Site (or frames or links to the Site) without proper authorization
  • Distribute computer viruses, worms, or any software intended to damage or alter a computer system without the owner's consent
  • Use any mechanisms that generate excessive network traffic
  • Either directly or through any person or entity, in any form or manner, copy, distribute, reproduce, incorporate, or allow unauthorized access to the Site, its content, or the Services; or
  • Modify, decompile, reverse engineer, disassemble or otherwise attempt to derive source code from the Services

DJL Training has no liability or responsibility to you for performance or nonperformance of such activities. DJL Training reserves the right to expel users and prevent their further access to the Site or Service for violating this Agreement or the law and the right to remove communications which violate the terms of this Agreement.

System and Network Security

Violations of system or network security of the Site or Service are prohibited, and may subject you to criminal and/or civil liability. DJL Training will investigate potential security violations, and may notify applicable law enforcement agencies if violations are suspected. You may not attempt to circumvent the authentication procedures or security of any host, network, network component, or account to access data, accounts, or systems that you are not expressly permitted to access. You may not interfere or attempt to interfere with service to any other user, host, system, or network on the Internet unless expressly permitted to do so. You may not share any passwords provided to you by DJL Training with any third-parties. If you would like DJL Training to make the Site available to third parties, please make such request by e-mail officemanager@djltraining.com. DJL TRAINING IS NOT RESPONSIBLE FOR ANY UNAUTHORIZED USE OR DISCLOSURE OF ANY PASSWORD.

Disclaimers and Limitation of Liability

Under no circumstances, including, but not limited to, negligence, shall DJL Training be liable for any special, incidental, indirect, or consequential damages that result from the use of, or the inability to use, Site or Service or any downloaded materials, even if DJL Training or its representative has been advised of the possibility of such damages. In no event shall DJL Training's total liability to you from all damages, losses, and causes of action (whether in contract, or otherwise) exceed the amount you paid to DJL Training, if any, for products purchased on this Site or Service.

Links to Other Site or Services

This site contains links to other websites. DJL Training makes no representation whatsoever regarding the content of any other site or services, which you may access from this Site or Service. When you access a third party's site or service, please understand that it is independent from DJL Training and that DJL Training has no control over the content on that site or service. A link to a third party's site or service does not mean that DJL Training endorses or accepts any responsibility for the content or use of such site or service. If you decide to leave our Site and access these third-party sites, you do so at your own risk.

General Provisions

Those who choose to access this Site or Service from other locations do so on their own initiative and are responsible for compliance with any applicable national, state or local laws.

This agreement and the use of this Site shall be governed by and construed in accordance with laws of the State of North Carolina, United States of America, without giving effect to any principles of conflicts of law. If any provision of this agreement is held to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions. Any legal action or proceeding relating to your access to, or use of, the Site or Service or DJL Training Intellectual Property on or through this Site or any purchase of DJL Training products on or through this Site will be instituted in a state or federal court in Durham County, North Carolina. You waive any right you may have to move or dismiss or transfer on the basis of personal jurisdiction or venue, or for convenience of any party or witness. This is the entire agreement between the parties relating to the subject matter hereof and you agree to indemnify DJL Training for any claims or damages resulting from your failure to abide by these terms and conditions.

To the fullest extent permissible pursuant to applicable law, DJL Training disclaims all warranties, express or implied, including, but not limited to implied warranties of merchantability, fitness for a particular purpose, quiet enjoyment, accuracy of data, non-infringement, security, or title. DJL Training does not warrant the accuracy, completeness or usefulness of any information contained on this Site or Service. DJL Training does not warrant that the functions contained in the materials available on this Site or Service will be uninterrupted or error-free, that defects will be corrected, or that the materials, this Site or Service or the server that makes them available are free of viruses or other harmful components. You (and not DJL Training) assume the entire cost of all necessary servicing, repair and correction.

This Site or Service is controlled and operated by DJL Training from its offices within the State of North Carolina, United States of America. DJL Training does not represent or guarantee the truthfulness, accuracy, or reliability or any of communications posted by other users or endorse any opinions expressed by users. You acknowledge that any reliance on material posted by other users will be at your own risk. DJL Training does not screen communications in advance and is not responsible for screening or monitoring material posted by users.

The materials in this Site or Service are provided "as is" and without warranties of any kind either express or implied. Moreover, any portion of the materials available on this Site or Service may include inaccuracies or typographical errors. Changes may be made, from time to time and without notice, to the materials available on this Site or Service, the Site or Service itself, and to the products described on this Site or Service.

Our privacy statement that discloses some or all of the ways we gather, use, disclose, and manage a customer or learner's data.

This PRIVACY POLICY is between you (You, Your, and Yours) and DJL Training, Inc. (DJL Training). By using this Site or any Service of DJL Training, you signify your agreement to these terms of use. If you do not agree to these Terms of Use, do not use this Site or Service. 

DJL Training may modify these TOU at anytime and such changes will be effective on the date that such modified TOU is posted on this Site. Use of the Site or Services after such changes have taken effect constitutes acceptance of all changes.

This statement discloses the privacy practices for the DJL Training Inc. websites and informs you about:

  • What personally identifiable information is collected
  • What organization is collecting the information
  • How the information is used and disclosed to third parties
  • What choices are available to you regarding collection, use, distribution, and correction of the information; and
  • What kind of security procedures are in place to protect the loss, misuse or alteration of information under the company’s control
  • "Personal information” is information that would allow someone to identify or contact you, including, for example, your full name, address, telephone number or email address

This Privacy Policy is incorporated into and subject to the terms of our Terms of Use and you agree to be bound by its terms and conditions. This policy only addresses our activities from our servers. Other sites (including those that we link to and third party sites or services which we co-brand, such as email) may have their own policies, which we do not control, and thus are not addressed by this policy.

Introduction

To provide you with the best possible service, DJL Training from time to time may ask for personal information. You may update or access the personal information you provide for your profile at any time on http://djltraining.com, (collectively, with the blog and Learning Management System). This can be done by logging on to any DJL Training Website and selecting either "Edit Your Profile", "Change my Profile" or "Edit Your User Information." For security measures, in order to protect your information, you must first enter your user name and password before you can make any changes to your user profile. When you update your user profile, your new information will update our records that day.

This policy is to make you aware as to who is collecting the information, what type of information is gathered and tracked, what the information is for, and with whom the information is shared.

Attention: http://djltraining.com is the main home page to DJL Training, Inc., which has the general privacy policy for the DJL Training Website. This policy illustrates customer information that could be collected throughout the DJL Training Website. It is possible that not all personal information outlined in this policy will be used, but we want you to be aware of our policy and understand our procedures.

Information Gathered and How it is Used

There are areas in which you can browse on the DJL Training Website without giving us personal information. There are, however, certain elective areas of the DJL Training Website, where, prior to entry, you will be asked for personal information. This information will be used by DJL Training to correspond with you, provide service and support, present a more personalized experience as you navigate the sites, process your orders, or supply you with requested information. The DJL Training Website may ask for the following information when collecting information through the registration process (or new member registration form) that allows access to the DJL Training Website: user's first and last name, email address, mailing address, phone number and center location preference. The DJL Training Website also provides the ability to request information and an Information Request Form will also ask for personal information from you. The information you provide through the Information Request Form is shared with the Affiliate or Franchise center, (collectively "Network Members"), the user has specified to engage in transactions or provide future services. We contractually require that the Network Members agree to abide by the restrictions on use and disclosure of personal information set out in this Privacy Policy. If you submit Personal Information in response to a Career Opportunity, please be advised that your personal information will be distributed within the company so that the hiring manager can contact you and potentially discuss an employment opportunity with you.

If you take advantage of the "Live Help" feature used on any of the sites, please be advised that this feature is managed and provided by a third party contractor. This one on one technical help provided as a courtesy to DJL Training customers. If you take advantage of the opportunity, a live person will gather your user name to facilitate the service, but will be contractually prohibited from disclosing your user name to others.

If you wish to receive information on how to become a DJL Training Franchisee, DJL Training will collect from the Franchise Information Registration Form on the DJL Training Website your name, address, email address, what territory you are interested in, time frame on when you would like to invest in your own business, and how you heard about us. The purpose for collecting this information is to enable our sales teams to respond to your inquiries with a better understanding of what type of training you are interested in purchasing.

If you register with the DJL Training Learning Management System site, you may receive emails from the system confirming and reminding you of various actions you have taken with us. This includes confirming a class registration or reminding you of an upcoming class.

With Whom DJL Training Shares Information

Except as specified herein or unless DJL Training has your permission or is required by law, DJL Training will not sell, rent, lease or otherwise provide your personal information to others from ways different than stated in this privacy statement.

Please remember that when you submit information to a discussion group or some other public forum, the information submitted will be deemed public information and will not be considered confidential.

As a general practice, we do not provide your personally identifiable information to third parties. So, for example, we do not sell your email address or your name and personal demographic information to mass marketers. However, by registering your profile on the DJL Training Website, you may receive emails automatically generated from the DJL Training Website that are directly related to your activity on the DJL Training Website and are not used for marketing materials and purposes. Further, on particular pages where we ask for your personally identifiable information, we may explicitly tell you that the data we are collecting on that page will be shared with third parties, in which case those disclosures shall override anything to the contrary in this policy. We will not share your information with a third party who does not contractually agree to maintain the confidentiality of that information using reasonable security measures.

In some situations, we share your personally identifiable information with third parties who provide services to our site in order to enhance the functionality available to you on our web site, and to provide you with information on new products and services. Further, in some cases, we use your personally identifiable information to provide information to you, such as to send newsletters to you that you request or to personalize the site in accordance with your requests.

Cookies and Other Technologies

The DJL Training Website may collect anonymous information from your communication connection itself, which consists of network routing, equipment information like browser type, date, and time. Our system will also search your computer to see if there are "cookies" previously set by the DJL Training Website. A cookie is a piece of data stored on the user's computer tied to information about the user.

The data we collect from "Cookie" technology on our site contains no personal information and is used in the aggregate to improve our services, product offerings and Website content, as well as to analyze traffic to our public website.

We also use cookies to keep track of your personalization options so that we can deliver content specific to your interests each time you visit us. These cookies are not tied to your personal information.

We do not offer an opt-out on our site for cookies, however browsers do provide you with information and control over cookies. Although you are not able to disable the cookie feature on this site, you are always free to decline our cookies if your browser permits, but some parts of the DJL Training Website may not work properly if you do.

Choice/Opt-out

If you decide to submit an Information Request Form, you will occasionally receive information on products, services, or special deals through announcement messages or newsletters. If you do not wish to receive our marketing materials and promotion communications, you may opt-out when submitting your personal information by sending us an email at webmaster@djltraining.com. If you chose to opt out please be advised that you will not be able to access the DJL Training Learning Management System site.

Compliance with U.S.-EU Safe Harbor and U.S.-Swiss Safe Harbor Framework Privacy Principles

To the extent that the DJL Training Website is used to collect, process or store personal data belonging to individuals located in, or employed by entities located in the European Union (“EU Parties”), or Switzerland, our handling of that data adheres to both the US-EU Safe Harbor Principles and the U.S.-Swiss Safe Harbor Frameworks (“Safe Harbor”). Although we use reasonable efforts to verify the accuracy of data submitted by users of the DJL Training Website, users are expected to update their personal information by going to the DJL Training Website when necessary to ensure that their personal data is accurate, complete and current. We are committed to cooperating with data protection authorities located in Europe and Switzerland to resolve and remedy any disputes that arise regarding data connected to individuals located in (or employed by entities located in) Europe and Switzerland.

Links

We occasionally place links to relevant, outside resources within the DJL Training Website. Be aware DJL Training is not responsible for the privacy practices or the content of such other sites. We encourage you to investigate and ask questions before disclosing information to third parties. If you do not want your information to be used, do not share your information with those sites. Third party links include learning centers outside the United States on the DJL Training Website.

Security

Only employees who need the information to perform a specific job (for example, a customer service representative) are granted access to personally identifiable information. Our employees must use password-protected screen-savers when they leave their desk. When they return, they must re-enter their password to re-gain access to user information. Furthermore, all employees are kept up-to-date on our security and privacy practices.

We have established and maintain reasonable security procedures to protect the confidentiality, security and integrity of your personally identifiable information. “Perfect security,” however, does not exist on the Internet. Although your privacy is very important to us, due to the existing legal regulatory and security environment, we cannot fully ensure that your private communications and other personally identifiable information will not be disclosed to third parties. For example, we may be forced to disclose information to the government or third parties under certain circumstances, or third parties may unlawfully intercept or access transmissions or private communications. Additionally, in the unlikely event we need to investigate or resolve possible problems or inquiries, we can (and you authorize us to do so) disclose any information about you to private entities, law enforcement or other government officials as we, in our sole discretion, believe necessary or appropriate.

We reserve the right to disclose your personally identifiable information as required by a court of competent jurisdiction and/or when we believe that disclosure is necessary to protect our rights and/or comply with any judicial proceeding, court order.

Public Forum

The community forums hosted in the DJL Training Website are monitored by DJL Training and visible to the Network Members. Any information you place on these message boards is public information. DJL Training may, in its sole discretion, delete any inappropriate postings. The community forum is an added benefit for you to communicate with others on specific technical topics. DJL Training is not responsible for the content of the postings in these forums, but reserves the right to manage content as set out in the DJL Training Website Terms of Use.

The community forums on our Learning Management System site is hosted and branded DJL Training. Please note that any information you place on these message boards is public information. DJL Training may, in its sole discretion, delete any inappropriate postings. The community forum is an added benefit for you to communicate with others on specific technical topics. The posting are monitored by DJL Training consultants and Subject Matter Experts.

Policy Updates

We may update this policy from time to time, to ensure we are using, collecting, and providing information in the same manner that is disclosed. If we decide to use personal information in a manner different than disclosed, we will use reasonable efforts to post any material changes on our DJL Training home page thirty (30) days before implementing them, thus providing you an opportunity to opt-out, if you determine that you are no longer interested in allowing access to your personal information.

Cancellation Policy

Our Cancellation Policy

Our cancellation policy provide our guidelines for refunds and substitute learners for training.

Private Businesses Courses

Open Enrollment Courses

Cancellations

You may cancel your course in writing, send an email to billing@djltraining.com, no less than 30 business days before the course begins.

You may cancel your registration in writing, send an email to billing@djltraining.com, no less than 7 business days before the course begins.

Refunds

To receive a partial refund, you must cancel your course in an email to billing@djltraining.com, at least 30 business days before the class.


No refund will be issued, nor will an outstanding invoice be canceled, for cancellations received less than 30 business days before the class.

If cancelled at least 30 days before the class date, your course fee will be refunded less a 20% cancellation fee (minimum $150). The remaining balance of your course fee will be applied on a pro-rated basis to your next purchased course.


Books and other materials purchased on your behalf will be shipped to you at your expense.

To receive a refund you must cancel your registration in an email to billing@djltraining.com, at least 5 business days before the class.


No refund will be issued for cancellations received less than 5 business days before the class.

Your registration fee will be refunded less a 20% administrative fee and the cost of your book.


Books and other materials purchased on your behalf will be shipped to you at your expense.

Substitutes

If a registered learner can not attend a class and you would like to send a substitute, you must unregister and register the learners accordingly. You may do so up to the day before the class provided that the substitute learner meets the prerequisite requirements of the class.

If you need to cancel your registration less than 7 business days prior to the course start date, you may send a substitute instead of cancelling your registration. 

Timeliness

Learners should arrive 15 minutes prior to class time. Learners who arrive 30 minutes late to class, may not be admitted. Learners who arrive late or leave early, will not receive a Certificate of Completion.

Please arrive 15 minutes prior to class time. If you arrive 15 minutes late, your seat may be given to another learner on standby. If you arrive 30 minutes late to class, you may not be admitted. If you arrive late or leave early, you will not receive a Certificate of Completion.
